Концептуализация порядка формирования государственных органов в теории конституци-онного права

Аннотация. Первейшая задача конституционно-правовой теории состоит в изучении конституционно-правового контекста употребления концепта «порядок формирования государственных органов», оценке его значения для науки и теории конституционного права, а также выработке единого методологического подхода к его изучению. В этой связи предпринимается попытка концептуализации порядка формирования государственных органов в контексте теории конституционного права. Продуцированы гипотезы о природе порядка формирования государственных органов и характере взаимосвязей основных и неосновных терминов, понятий и концептов, входящих в структуру концептосферы порядка формирования государственных органов. Как результат определяется концептосфера конституционно-правового института «порядок формирования государственных органов» и его понятийный ряд. Ставится задача изучения заданного понятия через многомерную систему координат и установления универсальных зависимостей между переменными – понятиями (порядок – формирование – государственные органы), образующими концепт «порядок формирования государственных органов». Корневым понятием среди них является «порядок», многомерная природа которого обусловливает многослойный и многоаспектный характер внутренней структуры рассматриваемого концепта в целом. Раскрывается комплексный характер внутренней структуры данного концепта. Сделана попытка соединить теоретико-методологические идеи социогуманитаристики с конституционно-правовыми конструкциями и организовать научное знание по заявленной проблеме в рамках предмета конституционного права. Изложена авторская позиция по вопросам определения соответствующих понятий и закономерностей их взаимосвязи.

Abstract. The foremost task of the constitutional and legal theory consists in studying of a constitutional and legal context of the use of a concept «an order of formation of public authorities», assessment of its value for science and the theory of constitutional law and also elaboration of uniform methodological approach to his studying. In this regard in article an attempt of conceptualization of an order of formation of public authorities in the context of the theory of constitutional law is made. It has allowed the author to produce hypotheses of the nature of an order of formation of public authorities and the nature of interrelations of the main and nonbasic terms, concepts and concepts entering into structure of sphere of concepts of an order of formation of public authorities. As the result is defined sphere of concepts of constitutional and legal institute an order of formation of public authorities and his conceptual row. In this regard statement by the author of a problem of studying of the set concept through the multivariate system of coordinates, and establishments of universal dependences between the variables concepts (an order – formation – public authorities) forming a concept an order of formation of public authorities is of scientific interest. The author believes that a root concept among them is «order» which multivariate nature causes the multilayered and multidimensional nature of internal structure of a concept an order of formation of public authorities in general. The complex nature of internal structure of a concept an order of formation of public authorities reveals. The scientific novelty is presented also here by attempt to connect in the author’s concept the theoretical and methodological ideas of a sociohumanitarian to constitutional and legal designs and to organize scientific knowledge of the stated problem within a subject of constitutional law. Besides, the author shows own position on definition of the corresponding concepts and regularities of their interrelation.
