Проблемы современной регламентации ответственности за убийство матерью новорожденного ребенка в России

Аннотация. В работе рассматривается ст. 106 УК РФ «Убийство матерью новорожденного ребенка» в современной редакции. Автор указывает на очевидные коллизии и пробелы. Так, при прочтении диспозиции данной нормы у правоприменителей возникают вопросы: с какого момента рождающийся ребенок приобретает статус человека, жизнь которого охраняется уголовным законодательством, а до каких пор он является лишь плодом беременной женщины? Каков срок, в течение которого ребенок считается новорожденным? Как толковать понятие «психотравмирующая ситуация»? Сколько по времени может длиться психотравмирующая ситуация и совпадает ли этот период со сроком новорожденности ребенка? И наконец, кто может являться матерью новорожденного ребенка, учитывая «суррогатное материнство»? Немаловажным по данному составу преступления автор считает и время возникновения умысла на причинение смерти своему ребенку, а также количество детей, родившихся у женщины в период единой родовой деятельности. Автор не только рассматривает существующие позиции в юридической науке на этот счёт, но и предлагает свое обоснованное мнение по приведенным проблемам. Кроме того, в статье поднимается вопрос о целесообразности существования такого преступления в числе привилегированных убийств, исследуются пути преодоления существующих недостатков законодательного регулирования убийства матерью новорожденного ребенка. В заключение автор приходит к выводу о необходимости внесения существенных изменений в формулировку ст. 106 УК РФ в случае, если её исключение из привилегированных видов убийства не будет поддержано правоведами и законодателем.

Abstract. The research deals with Criminal Code Article 106 of the Russian Federation «Murder by the mother of a newborn child» in the modern version. The author points to obvious impacts and gaps. Therefore, when reading the characters of this rule, the law enforcer raises a number of questions: at what point does the child who is born get the status of a person whose life is protected by criminal law, and until when is he only the ovary of a pregnant woman? What is the time limit for the child to be considered a newborn? How to interpret the concept of «psycho-traumatic situation»? How long can the psych-traumatic situation last, and does this period match with the term of the baby’s newborn? And, finally, who can be the mother of a newborn child, given the «surrogate motherhood», etc.? It is also significant for the configuration of the crime that the author considers the time of the origin of intent to cause death to his child, as well as the number of children born to a woman during the period of a single birth activity. The author not only examines the existing positions in the legal science on this matter, but also offers reasoned opinion on the gaps, that were mentioned earlier. In addition, the article raises the question of the realism of the existence of such a crime among the privileged murders, explores ways to overcome the existing shortcomings in the governmental regulation of the killing of the mother of a newborn child. In conclusion, the author comes to the supposition that it is necessary to make significant changes to the wording of Article 106 of the Criminal Code of the Russian Federation, otherwise to exclude from the domestic criminal code this type of privileged composition of the murder.
