Аннотация. Автор исследует процессуальные полномочия начальника органа дознания, закрепленные Федеральным законом № 440 от 30 декабря 2015 г. в ст. 40.2 УПК РФ. Анализируется новое законодательное определение дефиниции «начальник органа дознания», обосновывается дальнейшее расширение про-цессуальных полномочий начальника органа дознания, высказаны предложения по внесению изменений в УПК РФ. Исследованы отдельные проблемы разграничения процессуальных полномочий начальника органа дознания и начальника подразделения дознания.

Abstract. In this article the author examines procedural powers of the inquiry body chief. Such procedural powers is embodied in the Federal Law № 440 dated December 30, 2015 in the article 40.2 of the Code of Criminal Proce-dure of the Russian Federation. The new legislation regarding the definition of term “chief of the inquiry body” is examined, broadening of the procedural powers of the inquiry body chief is substantiated, legislative amendments to the Code of Criminal Procedure of the Russian Federation are proposed. In this article the author examines some problems of separation of powers between the inquiry body chief and the chief of the subunit of the inquiry body.
