Аннотация. В статье исследуется вопрос о системных качествах, которые приписываются праву. Автор выступает против поверхностных аналогий между «системами» в социальном, биологическом и техническом смыслах, указывает на трудности применения теории систем для описания и характеристики позитивного права. В работе разбираются некоторые аргументы в защиту тезиса о системности права и приводится критика таких аргументов.

The Age as Element of the Subject of a Crime

Abstract. The article is devoted to the problems of the age of criminal responsibility. Despite the fact that the rule establishing the age of criminal responsibility is valid for a long time, on this topic written numerous scientific papers in the science of criminal law, there are multiple discussions about the age of the subject. The article highlighted the shortcomings of this rule and proposed changes in the regulation. Different point of view of the authors are considered and analyzed, measures to improve the effectiveness of this rule are proposed. In addition, it is proposed to amend the Criminal Code of the Russian Federation.
