К вопросу о совершенствовании правового регулирования коммерческого найма жилого помещения

Аннотация. Гражданский кодекс Российской Федерации содержит главу 35 «Наем жилого помещения», которая регулирует договор коммерческого найма жилого помещения, составляющий один из четырех видов договоров найма. При этом регулирование данного договора содержит множество пробелов и противоречий. Во многих случаях законодатель неоправданно отошел от правила обеспечения баланса интересов сторон договора. Именно в связи с этим следует настаивать на реформировании главы 35 ГК РФ и применении к отношениям сторон по договору коммерческого найма жилого помещения общих положений о договоре аренды.

On the Question of Improvement of Legal Regulation of the Commercial Renting of Living Accommodation

Abstract. The Civil Code of the Russian Federation includes the chapter 35 dedicated «The Renting of Living Accommodation». The contract of the commercial renting of living accommodation is one of the four different types of the renting of living accommodation. And regulation of this contract contains many gaps and contradictions. In many cases the legislator doesn’t provide the balance of the parties interests without reasonable causes. In this connection it is necessary to insist on reform of the chapter 35 of The Civil Code of the Russian Federation and to apply general provisions of the contract of the lease to the relations of the parties under the contract of the commercial renting of living accommodation.
