Аннотация. Статья посвящена исследованию правовых последствий отсутствия государственной регистрации договора через определение ее правовой природы, изучение положений Гражданского кодекса Российской Федерации и судебной арбитражной практики. Обосновывается вывод о том, что само по себе отсутствие государственной регистрации договора, влекущее незаключенность договора, не всегда означает отсутствие правоотношения между сторонами такого договора.

Abstract. The article presents the analysis of legal consequences of the absence of state registration of the contract through the definition of its legal nature, the study of the provisions of the Civil Code of the Russian Federation and judicial arbitration practice. The conclusion is that the absence of state registration of the contract, which implies a not concluded contract, does not necessarily mean the absence of legal relation between the parties of this contract.
