Зачет при уступке права требования

Аннотация. Рассматривается вопрос разрешения конфликта интересов цессионария, цедента и должника в случае зачета при уступке права требования; анализируются способы защиты интересов цессионария и должника, а также вопрос ограничения зачета при уступке права требования кругом обязательств, которые могут быть предъявлены к зачету, по сроку их возникновения и наступления права требования по ним, в силу прямого указания закона, договором или согласием должника на уступку права требования.

Offset at a Concession of the Right of the Requirement

Abstract. Considering a question of the resolution of conflict of interests of the new creditor, the initial creditor and the debtor in case of offset at a concession of the right of the requirement, ways of protection of interests of the new creditor and the debtor, and also a question of restriction of offset are analyzed at a concession of the right of the requirement by circle of obligations which can be shown to offset, on term of their occurrence and approach of the right of the requirement on them, owing to direct instructions of the law, the contract or the consent of the debtor to a concession of the right of the requirement.
