Аннотация. В рамках данной статьи представлен анализ применения статьи 238 УК РФ при совершении данного общественно опасного деяния в сфере строительства. Автором раскрыты существующие проблемы применения данной нормы, проанализированы ведомственные документы

To the problem of interpretation and application of article 238 (Criminal Code RF)

Abstract. Within the framework of this article the analysis of application of the article 238 of the Criminal Code of the Russian Federation when this socially dangerous act in the sphere of building is committed is presented. Current problems of application of this rule are disclosed by the author, industry-specific regulatory documents are analyzed.
