Порядок одностороннего отказа от исполнения договора

Аннотация. В статье односторонний отказ от исполнения договора рассматривается как односторонняя сделка, определяются требования к форме отказа от исполнения договора, при этом предлагается по аналогии закона применять нормы об акцепте оферты о заключении соглашения об изменении или расторжении договора. Также в статье освещается вопрос о государственной регистрации отказа от исполнения договора, предлагаются рекомендации по правильному выражению воли стороны, которая отказывается от исполнения договора.

The Sequence of Unilateral Refusal to Perform a Contract

Abstract. A unilateral refusal to perform a contract is viewed in the article as a unilateral transaction, the requirements to the form of refusal to perform a contract are defined thereby it is suggested by the analogy of the law to apply the norms about the accepting an offer on making the agreement of changing or terminating the contract. The article also deals with the issue of the state registration of refusal to perform a contract, proposes recommendations concerning the appropriate way of expressing the will of a party that refuses to perform the contract.
